AP Digital provides a concierge Digital Asset Management service to assist organisations with compliance under national laws implementing Directive (EU) 2023/970 (the "EU Pay Transparency Directive"). Our services include the collection and processing of compensation data and related documents, preparation of gender pay gap reports and supporting analysis, and delivery of lawyer-vetted, submission-ready materials.
We do not provide legal advice. Our role is limited to data handling, analysis, and preparation of materials to support your compliance efforts. You remain solely responsible for your legal obligations, the accuracy of data you provide, and obtaining independent legal advice as required.
2. User Obligations
You represent and warrant that: - You have full authority to engage us and provide all data and documents submitted. - All information and data provided is accurate, complete, and lawfully obtained (including all necessary consents for personal data). - You will not upload any data that violates applicable laws or third-party rights.
3. Intellectual Property
We retain all intellectual property rights in our methodologies, templates, tools, and the general form and structure of deliverables. You own the raw data you provide and the final reports delivered to you.
You grant us a non-exclusive licence to use the data solely to provide the services.
4. Confidentiality and Data Protection

5. Limitation of Liability
To the fullest extent permitted by law: - Our total liability under or in connection with these Terms or the services shall not exceed the fees paid by you in the twelve (12) months preceding the claim. - We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, regardless of the cause. - We are not responsible for the accuracy or completeness of data you provide, or for your compliance with the Directive or any national law.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.
6. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the services, your data, or any breach of these Terms.
7. Termination
We may suspend or terminate access to the services if you breach these Terms. Upon termination, provisions that by their nature should survive shall continue.
8. Governing Law and Jurisdiction
